It is no secret that modern eDiscovery is shaped by the massive volumes of ESI. This often makes traditional manual document review impracticable and costly. It also greatly increases the challenge of protecting privileged information from inadvertent production. Federal Rule of Evidence 502 was enacted in 2008 in part to address this significant concern.

Join our complimentary webinar led by Brandi Walkowiak, one of Advanced Discovery’s most experienced practitioners and expert advisors, to learn how to protect against waiver of privilege using Clawback agreements, FRE 502, and quality control procedures. The webinar will cover:

  • The interplay between Federal Rule of Evidence 502 and Clawback Agreements
  • What constitutes “reasonable” steps to protect the privilege in the age of big data
  • What is “prompt” notice to the party
  • Considerations when drafting and negotiating your Clawback Agreements
  • When Rule 502 and your Clawback Agreement will not save you from Waiver
  • Safeguarding your Privilege Review in the age of big data
